3.0 POLICY
The University seeks to provide an environment to support faculty in accomplishing the mission and objectives of the University. In order to do so, and subject to state and federal law, faculty are granted certain rights. This policy serves as a compendium of University policies that reference those rights.
3.1 Faculty members have rights directly associated with the principle of academic freedom in accordance with PPM Section 9.
3.2 The University has established shared governance as set forth in PPM 1-12 and other applicable PPM sections. Faculty have the opportunity to participate in determinations of departmental governance, such as engaging with the department chair and colleagues as described in PPM 1-18.
3.3 Faculty members’ competence and behavior may be appropriately addressed in accordance with PPM Sections 8 and 9. Faculty members have the right to due process, as defined in PPM 9-9, in proceedings involving the possibility of disciplinary action, and as further set forth in PPM Section 9. Faculty members have the right to be judged by their colleagues in matters of promotion and tenure in accordance with a prescribed system of tenure set forth in PPM Section 8.
3.4 The University recognizes the necessity of faculty members being current in their discipline and regularly engaging in scholarship in order to be effective teachers in the classroom. To this end, the University creates appropriate policies and practices regarding travel, sabbatical leaves, leaves of absence, and reasonable expectations around non-teaching assignments in order to assist with faculty development opportunities (e.g. PPM 3-25, PPM 3-26).
3.5 Faculty members are supported and engage in study or research that is within their discipline and field of specialty. Faculty study and research is conducted in accordance with the scholarly standards of their discipline and field of specialty, is conducted for its own intrinsic value apart and aside from any preconceived results, and is subject to PPM 9-1.
3.6 Faculty members’ expectations of privacy in University IT Resources is set forth in PPM 10-2. Space and equipment may be recalled or reassigned at the discretion of the University administration.
3.7 Faculty members have the right to financial and legal support from the University in litigation brought against them as a result of the performance of their duties, according to the provisions of the Utah Governmental Immunity Act, Utah Code § 63G-7-9.
3.8 All faculty members have the right to examine any University records which are retrievable in their name, with the exception of legally privileged documents or other documents classified as confidential, and according to the laws of the state of Utah, Utah Code § 63G-2-101.
3.9 All faculty members have the right to a workplace free from unlawful discrimination in accordance with PPM 3-32.
