1.0 PURPOSE

The purpose of this policy is to outline the responsibilities of the President.

3.0 POLICY 

3.1 The President may exercise grants of power and authority as delegated by the Board of Higher Education, as well as the necessary and proper exercise of powers and authority not specifically denied to the University or the University’s administration, faculty, or students by the Board of Higher Education or by law, to ensure the effective and efficient administration and operation of the University consistent with the statewide strategic plan for higher education. The President may exercise all grants of power and authority described herein as deemed appropriate by the President, subject to law and Utah Board of Higher Education policy, notwithstanding any other policies, rules, or procedures to the contrary. All policies, rules, or procedures created prior to the enactment of this policy must be reviewed for consistency with, and to fulfill the tenets of, this policy prior to application. All policies implicated by this policy must be reviewed and revised, as appropriate.  

3.2 The President may:

3.3.1 appoint or employ administrative officers, deans, faculty members, professional personnel, and support personnel;

3.3.2 prescribe the duties for positions described in section 3.3.1;

3.3.3 determine the salary for an employed position described in section 3.3.1, in accordance with the University’s human resources policies;

3.3 The President may, after consultation with the Board of Trustees, exercise powers related to the University’s employees, including faculty and persons under contract with the institution, by implementing:

3.3.1 policies governing personnel;

3.3.2 furloughs;

3.3.3 reductions in force;

3.3.4 program reductions or discontinuance;

3.3.5 early retirement incentives that provide cost savings to the institution; and

3.3.6 other measures that provide cost savings, facilitate efficiencies, or otherwise enable the University to meet the University’s mission and role. 

3.4 The President shall:

3.4.1 control and manage the budget and finances of the University, including, as determined by the President:

3.4.1.1 establish the University’s budget; and

3.4.1.2 establishing or adjusting administrative or academic unit budgets; and

3.4.2 subject to Utah Code 53B-7-101, establish:

3.4.2.1 tuition for the University, including both resident and nonresident tuition, subject to the approval of the Board of Higher Education as described in Utah Code 53B-1-402; and

3.4.2.2 fees and other charges for the University; and

3.4.3 establish the organization and structure of the University, including by, as determined by the President, creating, merging, or eliminating a college, department, or other administrative or academic unit of the University. 

3.5 Subject to the approval of the Board of Trustees, the President:

3.5.1 shall establish a budgetary policy, such as policy regarding benefits and endowment investments;

3.5.2 subject to Utah Code § 53B-2-106.1, shall provide for the constitution, government, and organization of the faculty and administration, including:

3.5.2.1 enacting and implementing rules;

3.5.2.2 ensuring that the faculty may only have jurisdiction over academic requirements for admission, degrees, and certificates, and course curriculum and instructions;

3.5.2.3 permitting faculty to have jurisdiction over a matter other than a matter described in section 3.5.2.2 only if expressly authorized or delegated by the Legislature, the Board of Higher Education, the Board of Trustees, or the President;

3.5.2.4 the establishment of a prescribed system of tenure; and

3.5.3 may authorize the faculty to determine the general initiation and direction of instruction and of the examination, admission, and classification of students.

3.6 The President may establish policies for the administration and operation of the University that:

3.6.1 are consistent with the University’s role as established by the Board of Higher Education, rules enacted by the Board of Higher Education, and the laws of the state; and 

3.6.2 may provide for:

3.6.2.1 administrative, faculty, student, and joint committees with jurisdiction over specified University matters;

3.6.2.2 student government and student affairs organizations;

3.6.2.3 the establishment of University standards in furtherance of the ideals of higher education to which the University and the University’s administration, faculty, and students subscribe and foster; and

3.6.2.4 the holding of classes on legal holidays, other than Sunday.

3.7 The President shall manage the University as part of the Utah System of Higher Education.

3.8 In performing any of the acts described herein, the President may, in the President’s sole discretion, seek input from the University’s faculty, staff, or students. 

3.9 The President is subject to regular reviews and evaluation by the Board of Higher Education, in consultation with the Board of Trustees. Only the Board of Higher Education may formally assess the President’s performance, formally declare the President’s standing, or take other formal action to evaluate the President.
