Title IX/Sexual Misconduct:

Title IX of the Education Amendments Act of 1972 is a comprehensive federal law that prohibits discrimination or discriminatory harassment on the basis of sex in any federally funded educational institution’s program or activity. University policy also prohibits any form of discrimination or discriminatory harassment, including sexual misconduct.

Supportive Measures are individualized services reasonably available that are non-punitive, non-disciplinary, and not unreasonably burdensome to the other party while designed to provide equal access to educational or
employment-related opportunities, protect safety, or deter violations of this policy (PPM 3-32 8.1).

Prohibited Discrimination:

Weber State University policy prohibits any form(s) of discrimination based on protected classification. Discrimination is conduct which denies or limits a person's opportunities or adversely affects a term or condition of employment or participation in University programs, services, or activities based on a person's protected classification(s). Any suspected violations of PPM3-32 should be reported to the Office of Equal Opportunity. (Protected Classifications Defined in PPM3-32, 3.7)

Characteristics protected by U.S. federal law include: Race, color, national origin, pregnancy, and pregnancy-related conditions such as childbirth, false pregnancy, miscarriage, abortion, or related conditions, (including recovery), genetics, disability (see PPM 3-34), religion, sex, sexual orientation, gender identity/expression, veteran, active military status, age (over 40 in employment discrimination), and other classifications protected by law.

Discriminatory Harassment:

Unwelcome conduct that is based on protected classifications (as defined, below) that creates a hostile work or learning environment. A hostile environment exists when conduct is so severe, persistent or pervasive, as determined by analyzing the totality of the circumstances, that it denies or limits a person’s ability to participate in or benefit from the University’s programs or activities or the conduct has the purpose or effect of unreasonably interfering with an employee’s work performance or creates an intimidating, or offensive work environment. Both subjective and objective factors shall be considered when evaluating whether a hostile environment exists. Conduct is considered unwelcome if the person did not request or invite it and considered the conduct to be undesirable or offensive (PPM 3-32 3.4). Any suspected violations of PPM3-32 should be reported to the Office of Equal Opportunity. (Protected Classifications Defined in PPM3-32, 3.7)

Weber State University endeavors to ensure that its campus and programs are accessible and in compliance with state and federal disability standards. The University strives to provide reasonable accommodations to remove a barrier that may prevent an individual with a disability from equally participating in academics, employment, or other University programs. University policy (PPM 3-34), as well as state and federal law, strictly prohibits retaliation against an individual for requesting a disability accommodation or for participating in a disability discrimination complaint process.
