Welcome to Code Purple, Weber State University’s emergency notification system. Please review the following terms and conditions concerning your use of the program. By participating in the program, you agree to follow and be bound by these terms and conditions.

You agree that by participating in Code Purple, you are allowing Weber State University and it’s third party affiliate, Send Word Now (SWN), to send electronic messages to your University-owned telecommunication devices, as well as such devices you have registered with the Code Purple system.
You understand that you may be charged by your telecommunications carrier for regular voice and data fees on any personal devises registered with the program and that WSU and SWN will not be responsible for any charges that may be incurred.
You also agree that WSU and SWN may provide you with other information and materials describing the program and other services offered.
You agree that you are solely responsible for the accuracy of information given to WSU and SWN. You are responsible to update any information in a timely fashion. You represent that you are the holder of any rights in the devices submitted for electronic messaging.
You also represent that you have the right, authority and capacity to agree to and abide by these terms and conditions.
Message delivery is dependent on many factors, including local phone carrier networks. Depending on the nature and scale of the emergency, message delivery may be unavailable or delayed. WSU will attempt to report clear and accurate information, however, in the event of an emergency, there is the possibility of error or misunderstanding. WSU DISCLAIMS ANY AND ALL LIABILITY IN CONNECTION WITH MESSAGE DELIVERY OR THE ACCURACY OF INFORMATION GIVEN BY WSU AND SWN. WSU DOES NOT WARRANT THAT THE CODE PURPLE PROGRAM WILL OPERATE ERROR FREE. You, for yourself and on behalf of your heirs, assigns, personal representatives and next of kin, agree to release, indemnify and hold harmless WSU, its officers, directors, employees, officials and agents from any and all claims, demands, losses and liability, including without limitation reasonable legal and accounting fees, arising out of or related to any injury, disability or death you may suffer, or loss or damage to person or property to the fullest extent permitted by law alleging or resulting from your participation in the Code Purple program. You KNOWINGLY AND FREELY ASSUME ALL SUCH RISKS, both known and unknown, and assume full responsibility for your participation in the Code Purple program.
Any action related to these Terms will be governed by Utah law and controlling U.S. federal law, regardless of any choice of law provisions. You agree that the state courts of Utah or the federal court located in Utah will have jurisdiction over all actions.
WSU reserves the right to discontinue service at any time and to remove any user from the program where it is reasonably believed that these terms have been breached or the User is no longer affiliated with WSU.
The Privacy Policy and following disclaimer are incorporated into these Terms and Conditions by reference. These terms represent the entire understanding relating to the use of the program and prevail over any prior or contemporaneous, conflicting or additional communications. WSU has the right to revise the Terms at any time without notice by updating this posting. WSU reserves all rights not expressly granted herein.

Code Purple is being offered by the university through Send Word Now for general informational purposes in an effort to help users make decisions relating to fast-breaking developments. During the test period and pilot stages of the program, various problems may arise. Weber State University will make every effort to keep users supplied with timely and accurate information regarding the program and any problems that have or may occur. The university assumes no duties to users or others and disclaims any right for such persons to rely on the system or its messages. All individuals who participate in the program, voluntarily or involuntarily, release the University from any and all claims arising from the use of the program. All individuals further agree to the Terms and Conditions as adopted by the university.
